What This Provision Covers

Applies to an owner or lessee who causes an uninsured motor vehicle to be operated on a highway, subject to applicable exemptions.

A set fine is not the same as a court sentencing range. Standard totals include the surcharge and $5 service costs where a fixed set fine is listed. Court penalties and extra costs may differ.

No-set-fine entries and variable formulas remain uncalculated. A blank amount does not mean there is no penalty.

No Insurance or No Proof of Insurance?

These are different allegations. A driver may have valid coverage but fail to carry or surrender the required insurance card. Operating without insurance concerns the absence of required coverage.

Check the Act and section printed on your ticket or summons. The facts, insurance policy and any applicable exemptions matter.

Statutory Penalties for This Provision

For an owner or lessee convicted under section 2(3), the statutory fine range is $5,000–$25,000 for a first conviction and $10,000–$50,000 for a subsequent conviction. The court may also suspend the driver’s licence for up to one year and order vehicle impoundment for up to three months under section 2(7).

Statutory fine amounts exclude applicable surcharges and costs. The proceeding, exemptions and any statutory relief require assessment.

Driver Demerit Points

0 driver demerit points. The current Ontario Regulation 339/94 table ↗ does not assign points to this specific conviction. Suspension, insurance, other convictions and CVOR consequences are separate. Checked October 29, 2026.

Insurance Consequences

Insurance consequences depend on the particular conviction, the policy and the insurer. An unassigned point value does not establish that a conviction has no insurance effect.
