Ontario Automobile Insurance Charges

The Compulsory Automobile Insurance Act covers uninsured vehicles, proof of insurance and false insurance cards. Find the section on your ticket or summons below.

No Insurance or No Proof of Insurance?

These are different allegations. A driver may have valid coverage but fail to carry or surrender the required insurance card. Operating without insurance concerns the absence of required coverage.

Check the Act and section printed on your ticket or summons. The facts, insurance policy and any applicable exemptions matter.

Insurance Charges and Statutory References

Statutory Penalties

For an owner or lessee convicted under section 2(3), the statutory fine range is $5,000–$25,000 for a first conviction and $10,000–$50,000 for a subsequent conviction. The court may also suspend the driver’s licence for up to one year and order vehicle impoundment for up to three months under section 2(7).

For false or invalid insurance card offences under section 13.1, the statutory range is $10,000–$50,000 for a first conviction and $20,000–$100,000 for a subsequent conviction.

Section 2(6) has a statutory maximum fine of $200. Sections 3 and 4 have a statutory maximum fine of $400. These statutory amounts are separate from set fines and exclude applicable surcharges and costs.

These are the ranges in the Act. The applicable proceeding and any statutory relief require assessment. They are not a prediction of an individual sentence.

All five Schedule 1 entries are included. Twelve additional descriptions summarize driver and owner provisions; they are editorial descriptions, not official court short-form wording. Cause and permit are separate descriptions of the same paragraph, as are the two section 3(2) duties.

This addition does not catalogue insurer, agent, Facility Association or regulatory compliance offences. Exemptions and individual application require review. Database coverage and limitations →
